1. Introduction
Welcome to CommonplaceLounge ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at commonplacelounge.sbs (the "Service") operated by CommonplaceLounge.
By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
2. Service Overview
CommonplaceLounge offers high-end yacht charter services, which include:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
Service availability is dependent on whether conditions permit. The availability and continuance of services are at our discretion.
3. Booking and Reservations
3.1 Booking Process
For a charter reservation, the following requirements must be fulfilled:
- Minimum age of 18 years
- Accurate and complete details provided
- Payment of the specified deposit according to your booking confirmation
- Acceptance of these Terms & Conditions
3.2 Confirmation
A charter is considered booked only after payment is received and we send you a written confirmation. We may decline service at our discretion.
3.3 Availability
Charter bookings are contingent on the availability of vessels and appropriate weather. We will make reasonable attempts to meet your preferred schedule.
4. Payment Terms
4.1 Pricing
Pricing is quoted in € and includes relevant taxes unless stated otherwise. Prices may change without prior notice.
4.2 Payment Schedule
- Deposit: 50% of the total cost of the charter due at the time of reservation
- Remaining Balance: Payable 48 hours before departure
- Incidental charges (if any): Payable upon completion of charter
4.3 Payment Methods
We accept major credit cards, bank transfers, and certified cheques. Payments are processed using secure, encrypted methods.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours before departure: Full refund minus processing fees
- 24-72 hours before the trip starts: 50% refund
- Less than 24 hours before the trip: No refund
5.2 Weather Cancellations
In case of unsafe weather conditions as judged by our captain, we will present the options to:
- Rebook your trip to an available upcoming date without additional fees
- Issue a full refund if an alternate schedule cannot be arranged
5.3 Mechanical Issues
If a mechanical issue arises with a designated vessel, we will strive to supply an appropriate substitute. If no alternative is available, you will be refunded in full.
6. Safety and Conduct
6.1 Safety Requirements
All passengers are required to:
- Follow all instructions given by the crew
- Don safety equipment as directed
- Declare any medical conditions that could impair safety
- Stay in designated areas on the vessel
6.2 Prohibited Items
Items not allowed on the yacht include:
- Glass items
- Illegal substances
- Weapons or firearms
- Pets, unless permission is granted beforehand
6.3 Conduct
Passengers should behave in a well-mannered way. A voyage may be terminated without a refund if passenger actions endanger safety or otherwise impede the enjoyment of others.
7. Liability and Insurance
7.1 Our Liability
Liability on our part is limited to the amount paid for the yacht charter. We are not liable for:
- Injuries sustained due to passenger wrongdoing
- Loss or destruction of personal belongings
- Indirect, subsequent, or punitive damages
- Delays arising from weather or other circumstances outside our control
7.2 Insurance Coverage
We maintain complete marine insurance that includes our fleet and operations. Passengers ought to arrange their own travel and personal insurance.
7.3 Assumption of Risk
By using our charter services, you recognize that maritime activities involve inherent risks and you accept personal responsibility for your safety and welfare.
8. Modifications and Itinerary Changes
Itinerary alterations, such as route or schedule changes, may occur because of weather, safety concerns, or operational needs. Every attempt will be made to provide similar alternative experiences.
9. Force Majeure
Incidents beyond our control, including but not restricted to the following, do not hold us liable for delays, cancellations, or changes:
- Extreme weather
- Natural calamities
- Government ordinances
- Port closures
- Vessel malfunctions
10. Privacy and Data Protection
We handle your personal data in alignment with our Privacy Policy. You consent to the gathering and use of your information as detailed in our Privacy Policy by using our services.
11. Intellectual Property
Copyright and trademark laws protect the content of our site, such as text, imagery, logos, and graphics. Unauthorized reproduction, distribution, or creation of derivatives is not permissible without our explicit consent.
12. Governing Law
The applicable laws of Germany govern these Terms. Any legal disputes will be settled in the courts of Hamburg, Germany.
13. Changes to Terms
We reserve the ability to adjust these Terms when necessary. Updated terms will be posted on our website with a revised date of effect. Continued service use denotes acceptance of the new terms.
